These general terms and conditions of sale (conditions générales de vente, CGV) govern the relationship between WhyTrek, Julien Callet, entrepreneur individuel (sole trader) under the micro-entreprise scheme, SIREN 982 057 218, hereinafter “WhyTrek”, and any person booking a service, hereinafter “the participant” or “the customer”. Any booking implies unreserved acceptance of these CGV.
1. Services offered
WhyTrek offers guided hiking outings, micro-adventure trips, themed outdoor experiences (dedicated events) as well as guiding and advisory services. Each service is covered by a description setting out the programme, the duration, the level required, the capacity and the public price per participant where it is a dedicated event. Services for companies are the subject of a personalised quote.
2. Booking
Bookings are made through the contact form on the site, through the registration form provided by WhyTrek or through the dedicated WhatsApp community. The booking is confirmed after discussion with WhyTrek and, where applicable, receipt of payment. WhyTrek reserves the right to refuse a registration where the participant’s level does not match the difficulty of the outing, for safety reasons.
3. Prices and payment
The prices of dedicated events are shown in euros, inclusive of all taxes, per participant. WhyTrek falls under the micro-entreprise regime: VAT not applicable, Article 293 B of the Code général des impôts (French General Tax Code). The payment arrangements are specified when the booking is confirmed.
4. Droit de rétractation (right of withdrawal)
In accordance with Article L221-28 12° of the Code de la consommation (French Consumer Code), leisure services supplied on a specified date or with a specified periodicity are not subject to the droit de rétractation (right of withdrawal). Registration for an outing scheduled on a specific date cannot therefore be withdrawn from. The cancellation conditions are set out below.
5. Cancellation and modification
Cancellation by the participant: the cancellation conditions and time limits, together with any refund arrangements, are communicated to the participant when the booking is confirmed.
Cancellation by WhyTrek: for safety reasons (unfavourable weather conditions, weather alerts, impassable terrain) or where there are insufficient participants, WhyTrek may cancel or postpone an outing. In that case, the participant is offered either a postponement or a full refund of the sums paid for the cancelled service.
6. Safety, level and responsibility of the participant
Hiking and outdoor activities involve inherent risks. The participant undertakes to provide truthful information about their state of health and their level, to have suitable equipment and to comply with the guide’s safety instructions. The guide may, at any time and for safety reasons, adapt, shorten or interrupt an outing. Minors must be accompanied or must hold parental authorisation in accordance with the arrangements communicated.
7. Insurance
WhyTrek holds professional liability insurance. Each participant is advised to have individual insurance covering outdoor activities. The references of WhyTrek’s insurance are provided on request.
8. Personal data
Personal data provided in connection with a booking is processed in accordance with the site’s Privacy Policy. Any health information forms collected are destroyed after the service.
9. Gift vouchers
WhyTrek issues gift vouchers with a value of 40, 80 or 120 euros, as well as vouchers for a free amount from 30 euros. The voucher is sent to the customer electronically, in a digital and printable version, once the amount has been received.
The voucher is valid for twelve months from its date of issue, which is stated on the voucher. After that period it can no longer be used and gives rise to no refund or extension, unless WhyTrek agrees in writing.
The voucher is issued in the name of the holder and may be transferred to a third party. It is set against the price of the service chosen from those offered by WhyTrek on the date of use. If the price of the service is higher than the value of the voucher, the balance is paid by the beneficiary in accordance with the arrangements provided for in Article 3. If it is lower, the remainder stays usable until the voucher expires.
The voucher cannot be refunded or exchanged for cash, in whole or in part. Nor can it be resold. In the event of loss, WhyTrek may issue a duplicate on request, provided that the original purchase can be identified.
Use of the voucher constitutes a booking for a service and remains subject to the cancellation and modification conditions provided for in Article 5. A cancellation by the beneficiary under the conditions set out there may result in the loss of the corresponding amount.
The purchase of a gift voucher at a distance gives the customer a withdrawal period of fourteen days from its acquisition, in accordance with Article L221-18 of the Code de la consommation, for as long as the voucher has not been used to book a service on a specified date. Once the booking has been made, the exclusion provided for in Article 4 of these terms applies.
10. Applicable law and disputes
These CGV are subject to French law. In the event of a dispute, the participant is invited to contact WhyTrek in order to seek an amicable solution.
In accordance with Articles L611-1 et seq. of the Code de la consommation, consumers may use a médiateur de la consommation (consumer ombudsman) free of charge. The competent mediator is Société Médiation Professionnelle, 24 rue Albert de Mun, 33000 Bordeaux, www.mediateur-consommation-smp.fr. WhyTrek has been a member of this scheme since 14 May 2026. Referral to the mediator requires that a written complaint has first been sent to WhyTrek and has remained unresolved.
Failing an amicable settlement, the French courts have jurisdiction.
